Welcome to Red Dog Contracting (“Company,” “we,” “our,” or “us”). By accessing or using our website, services, proposals, or entering into agreements with us, you (“Client,” “you,” or “your”) agree to the following Terms & Conditions. Please read them carefully.
1. Scope of Services
Red Dog Contracting provides construction, contracting, and related services as outlined in individual contracts, proposals, or bids. Services are performed in accordance with project specifications and applicable laws.
2. Estimates & Proposals
Estimates are provided based on available information at the time of request and are subject to change.
Final pricing will be outlined in written agreements, contracts, or purchase orders.
Acceptance of a proposal constitutes agreement to these Terms & Conditions.
3. Sharing of Information
Payment schedules and terms will be outlined in each contract or invoice.
Late payments may result in additional charges, interest, or suspension of services.
For projects requiring deposits, work will not commence until the deposit is received.
All payments are non-refundable unless otherwise stated in writing.
4. Client Responsibilities
Clients agree to:
Provide accurate project details, property access, and necessary permits or approvals.
Ensure the worksite is safe, secure, and free of hazards.
Respond in a timely manner to communications, approvals, and requests that impact project progress.
5. Subcontractors & Third Parties
We may engage subcontractors, vendors, or suppliers as necessary to complete projects. Red Dog Contracting is not responsible for delays or damages caused by third parties outside of our reasonable control.
6. Changes & Modifications
Any changes to project scope, materials, or specifications must be agreed upon in writing and may result in additional costs or timeline adjustments.
Verbal agreements are not binding unless confirmed in writing.
7. Warranties & Disclaimers
Workmanship warranties will be provided as outlined in project-specific agreements.
We do not guarantee performance of third-party materials, equipment, or manufacturer warranties.
Services are provided “as is” without any implied warranties unless explicitly stated in writing.
8. Limitation of Liability
To the maximum extent permitted by law:
Red Dog Contracting shall not be liable for indirect, incidental, or consequential damages.
Our total liability shall not exceed the amount paid by the Client for the specific project giving rise to the claim.
9. Delays & Force Majeure
We are not responsible for delays or failure to perform due to events beyond our reasonable control, including but not limited to weather, natural disasters, labor disputes, supply shortages, government actions, or other unforeseen circumstances.
10. Termination
Either party may terminate a contract with written notice if the other party materially breaches the agreement.
In the event of termination, the Client is responsible for payment of all services performed, materials purchased, and expenses incurred up to the termination date.
11. Intellectual Property
All plans, designs, proposals, and project documents prepared by Red Dog Contracting remain the property of the Company unless otherwise agreed in writing.
12. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes will be subject to the exclusive jurisdiction of the courts located in Amarillo, TX.
13. Amendments
We reserve the right to update or modify these Terms & Conditions at any time. Updates will be posted on our website with the revised effective date.
